BRAC seeks a Head of Litigation – Legal and Compliance in the Head Office of Dhaka, Bangladesh; candidates must have a minimum of 7-8 years of Bangladesh court practice, etc.

 

JOB PURPOSE
The Head will lead the department’s litigation support services across courts, regulatory bodies, and dispute resolution forums, proactively minimizing legal exposure, risks, and costs. This role also involves overseeing regulatory compliance and the broader legal operating environment, ensuring alignment with internal policies and applicable laws. Additionally, the Head will drive effective legal risk management strategies to ensure optimal recovery and robust protection of BRAC’s legal interests.

 

KEY RESPONSIBILITIES
• Supervision and administrative responsibilities, performance management and disciplinary processes for litigation staff. Manage budget and expenses for litigation affairs. Responsible for internal audit responses on litigation.
• Lead, manage and develop litigation staff and their tasks with efficient systems and processes for continuity of work and optimal delivery. Maintain litigation tracking systems and databases with updated information, and report regularly to supervisor on progress of potential and existing litigation, and all related tasks.
• Collaborate and work with senior and departmental leadership in identifying, reducing and mitigating potential or actual legal risks in legal enforcement, claims, disputes and litigation; and in risks related to law and internal policies.
• Liaise with and monitor legal matters and litigation referred to external legal counsel; maintain contracts, ensure payment of legal bills and evaluate performance of external legal counsel for litigation and related matters.
• Visit and make representations, as necessary, field offices, branches, courts, tribunals and other dispute resolution forums, govt. offices, law chambers, enterprises and other places as assigned.
• Draft, review and give legal opinions on laws, legal claims, legal issues (including employment issues), litigation, internal organisational documents, proposals, policies and other documents, and on legal, regulatory and internal policy/procedure compliance matters, compliant with laws and internal policies/procedures, identifying potential legal risks, assessing the issues impacting legal risks and possible mitigations, and balanced against organizational mission and strategy, with proactive measures and approaches to reduce legal exposure and legal risks, and optimal recovery and protection of legal interests.
• Understand and ensure compliance with organizational policies and procedures. Support, develop and review organizational policies, procedures and other documents regularly and as necessary. Analyse, report on and implement response to legal and regulatory changes. Design and conduct trainings and workshops on litigation support services, and relevant organisational policies and procedures.
• Contribute to budget preparations and revisions of the department, monitor departmental and litigation support services costs on a regular basis.
• Coordinate internal audit activities and responses within the department.
• Conduct and participate in trainings and workshops on litigation support services and relevant organisational policies and procedures, with lessons learnt from litigation and judgements, updates on relevant laws, internal organizational documents and legal developments, within the department, and within the organisation as needed.
• Maintain confidentiality when preparing, sharing and storage of information and documents.
• Any other task assigned by the supervisor from time to time.

 

SAFEGUARDING RESPONSIBILITIES
• Establish a safeguarding culture across all levels of the programme by implementing the safeguarding policy. Act as a key source of support, guidance and expertise on safeguarding for establishing a safe working environment.
• Responsible to ensure team members are appropriately trained, supported and have access to resources regarding issues that are identified and implemented in accordance with the safeguarding policy and procedure.
• Follow the safeguarding reporting procedure in case any reportable incident takes place and encourage others to do so.

• Gives in-depth, legal, focused advice, with organisational alignment and fit for purpose. Good at influencing others, negotiation and dispute resolution.
• High degree of professional ethics and integrity, and maintains confidentiality.
• Understands the different demands of a law department role versus an external lawyer role.
• Excellent knowledge of legal system, sources of laws, commercial laws and remedies in Bangladesh. Independently maintains updated on relevant legal knowledge. Excellent legal research skills.
• Excellent knowledge of litigation, dispute resolution processes and civil/criminal remedies in Bangladesh.
• Good in assessment/mitigation of legal/regulatory risks, reputational/ethical issues.
• Good legal drafting and review skills in legal documentation, correspondence and documents in general, with attention to detail.
• Ability to work in a diverse environment. Be willing to travel and work outside office hours.
• Proficiency in word processing and internet research.
• Good in both Bangla and English language (spoken, reading, writing) communication.

 

EDUCATIONAL REQUIREMENTS – LL. B (Hons.)/LLM from any reputable university with expertise in criminal law, financial laws, commercial law, employment/labour law, procedural law, administrative law, company law, intellectual property laws, technology laws, privacy and data protection laws, and dispute resolution

 

EXPERIENCE REQUIREMENTS – Minimum 7 to 8 years’ Bangladesh court practice in subordinate courts and Supreme Court in commercial law disputes, or in litigation department of development, financial or business organisations.
